Scheme for Condonation of Delay for Companies Restored during December 2020

Scheme for condonation of delay for companies restored on the Registrar of companies between 01.12.2020 and 31.12.2020 under section 252 of the Companies Act, 2013.

The companies fresh start scheme, 2020 operationalized vide circular no. 12/2020 dt. 30.03.2020 and extended vide general circular no. 30/2020 dt. 28.09.2020 is no longer applicable for various filings done under the Provision of companies act.

Many people had filed appeals under 252 of the act against the order of striking off names of the companies before NCLT for which order was passed in December 2020 and such companies couldn’t prevail benefit of CFSS (Companies fresh start scheme).

Accordingly to provide such companies benefit of waiver of additional fees without any immunity from civil/ criminal proceedings etc. Central government has decided to introduce the scheme namely “Scheme for condonation of delay for companies restored on the Register of companies between 01.12.2020 and 31.12.2020 under section 252 of the Companies act, 2013” for the purpose of condoning the delay in filing forms with the registrar, insorfar as it relates to charging of additional fees on account of delay in such filings.

Details of scheme:

The scheme shall come in effect from 01.02.2021.

The scheme will be applicable for companies who have appeal was disposed by NCLT bench for restoring name of the company between 01.12.2020 to 31.121.2020.

The last date to file form under this scheme shall be 31.03.2021.

Every company will have to pay normal filing fees.
