Due date for DPT-3 and other forms for companies and LLP extended by MCA | No Late fees to be levied

MCA has extended due date/ relaxed late fees for various forms which were due between the period 01.04.2021 to 31.07.2021. Thus, normal fees shall be levied for filing of Forms till 31.08.2021 which were due between 01.04.2021 to 31.07.2021.

This extension is applicable on all forms due between above date other than CHG-1, CHG-4 Form and CHG-9.

The above circular shall cover DPT-3 Forms for company and Form 11 for LLP among others and thus due date for DPT-3 and other forms have been extended to 31.08.2021 without any additional/ late fees.

Circular 11/2021 Dt. 30.06.2021 has extended the above due dates which is as under:

“In continuation to this ministry’s general circular No. 06/2021 dated 03.05.2021 and on account of requests for further extension of timelines specified in the said circular, it has been decided to grant additional time upto 31st August, 2021 to company/LLPs to file form under the Companies Act, 2013/ LLP Act, 2008 (other than a CHG-1 Form, CHG-4 Form and CHG-9 Form) which were/ are due for filing during 1st April, 2021 to 31st July, 2021 without any additional fees. Accordingly, only normal fees shall be levied upto 31st August, 2021 for forms (other than charge related forms referred above) required to be filed during 1st April, 2021 to 31st July 2021.”

Circular 12/2021 Dt. 30.06.2021 substitutes 31.05.2021 and 01.06.2021 with 31.07.2021 and 01.08.2021 as mentioned in earlier circular no. 07/2021 Dated 03.05.2021.

Thus, in case of CHG-1 and CHG-9 period from 01.04.2021 to 31.07.2021 shall not be reckoned for the purpose of counting number of days under section 77 & 78 of the Act.
