Various Apparent issues in ITR 3 for AY 2021-22

Simple ITR 3 Returns for FY 2021-22 filed through software. Such returns are getting filed through DSC but Aadhaar OTP issue continues. Acknowledgment and IT Return form is getting downloaded instantly as well as reflecting on the portal simultaneously.

Pertinent Issues continues:

1. Even if new tax regime is not exercised, it is shown as exercised and deduction under Chapter VIA – u/s 80C of Rs.150000/- is permitted.

2. Are you filing return of income under Seventh proviso to Section 139(1)- though not selected it is shown as selected, consequently sub questions are also deemed to shown as selected whereas such sub questions are not applicable.
bi. Have you deposited amount or aggregate of amounts exceeding Rs. 1 Crore in one or more current account during the previous year? (Yes/No)……………..shown as yes but value is zero
bii. Have you incurred expenditure of an amount or aggregate of amount exceeding Rs. 2 lakhs for travel to a foreign country for yourself or for any other person…………shown as yes but value is zero
biii. Have you incurred expenditure of amount or aggregate of amount exceeding Rs. 1 lakh on consumption of electricity during the previous year? (Yes/No)……shown as yes but value is zero

3. Do you want to claim the benefit under section 115H? (applicable in case of resident)……….not selected but shown as selected.

4. Whether this return is being filed by a representative assessee? If yes, furnish following information – shown as selected but without filing such details return got filed.

5. Whether you were Director in a company at any time during the previous year?……selected as yes whereas answer is No, but without filing directorship details return is getting filed.

6. Whether you are Partner in a firm? where assessee is not partner thus NA but selected as yes, but without filing such details return is getting filed.

7. Whether you have held unlisted equity shares at any time during the previous year?……..no shares held but selected as yes whereas answer is No, but without filing shares details return is getting filed.

8. In case of non-resident, is there a permanent establishment (PE) in India?………….selected as Yes …………….how it is possible in case of Resident assessee to specify such answer.

9. Whether assessee is located in an International Financial Services Centre and derives income solely in convertible foreign exchange?………..selected as Yes …………….how it is possible in case of Individual Resident assessee to specify such answer.

10. Are you liable to maintain accounts as per section 44AA?……………selected as yes by default

11. Whether assessee is declaring income only under section 44AE/44B/44BB/44AD/44ADA/44BBA/44BBB. Selected as yes by default …………………when no such details are filled up but return is getting uploaded.

12. If No , Whether during the year Total sales/turnover/gross receipts of business exceeds Rs. 1 crores but does not exceed Rs. 10 crores?…….selected as yes by default …………………when no such details are filled up but return is getting uploaded.

13. If Yes is selected at a2i, whether aggregate of all amounts received including amount received for sales, turnover or gross receipt s or on capital account like capital contributions, loans etc. during the previous year, in cash, does not exceed five per cent of said amount?………..selected as yes by default …………………when no such details are filled up but return is getting uploaded.

14. Are you liable for audit under section 44AB? ………….selected as yes by default …………………when no audit is applicable but ROI is getting filed without audit reports details

15. Is there any change in method of accounting ……….selected as yes by default ……………..when there is no change in the method of accounting at all and it is reported as No …………….

16. Do you at any time during the previous year,
(i) hold, as beneficial owner, beneficiary or otherwise, any asset (including financial interest in any entity) located outside India; or
(ii) have signing authority in any account located outside India; or
(iii) have income from any source outside India? [applicable only in case of a resident] [Ensure Schedule FA is filled up if the answer is Yes ]…………….but selected as yes whereas answer is No ……………………but without filing information and details return is getting filed ………………….

In nutshell, there appears to significant system snags, so sincerely recommended avoid filing ITR 3 returns till the issue is resolved on the new ITD Portal.
